{"id":244,"date":"2023-08-11T19:14:27","date_gmt":"2023-08-11T22:14:27","guid":{"rendered":"https:\/\/lenglerlaw.com\/?p=244"},"modified":"2024-03-04T16:35:14","modified_gmt":"2024-03-04T19:35:14","slug":"constricao-judicial-de-bens","status":"publish","type":"post","link":"https:\/\/lenglerlaw.com\/en\/constricao-judicial-de-bens\/","title":{"rendered":"Possibility of Foreclosure of Spouse\u2019s Assets"},"content":{"rendered":"<p>The 3rd Panel of the Brazilian Superior Court of Justice (STJ) decided, in the judgment of Resp 1.830.735, that it is possible to judicially constrict the assets of the spouse married under the community property system, even if such spouse is not a party to the lawsuit,\u00a0as long as\u00a0the moiety (marriage portion) is safeguarded.<\/p>\n<p>In the case, STJ rejected the argument that the wife is not the original debtor, nor a party to the lawsuit.
