{"id":202,"date":"2019-07-09T16:56:46","date_gmt":"2019-07-09T19:56:46","guid":{"rendered":"https:\/\/lenglerlaw.com\/?p=202"},"modified":"2024-02-28T16:58:32","modified_gmt":"2024-02-28T19:58:32","slug":"o-contrato-de-trabalho-dos-artistas-e-tecnicos-em-espetaculos-e-diversoes","status":"publish","type":"post","link":"https:\/\/lenglerlaw.com\/en\/o-contrato-de-trabalho-dos-artistas-e-tecnicos-em-espetaculos-e-diversoes\/","title":{"rendered":"O Contrato de Trabalho dos Artistas e T\u00e9cnicos em Espet\u00e1culos e Divers\u00f5es"},"content":{"rendered":"<div class=\"elementor-element elementor-element-4e45a87 e-flex e-con-boxed e-con e-parent\" data-id=\"4e45a87\" data-element_type=\"container\" data-settings=\"{&quot;content_width&quot;:&quot;boxed&quot;}\" data-core-v316-plus=\"true\">\n<div class=\"e-con-inner\">\n<div class=\"elementor-element elementor-element-a07d9f0 elementor-widget__width-initial elementor-widget elementor-widget-theme-post-content\" data-id=\"a07d9f0\" data-element_type=\"widget\" data-widget_type=\"theme-post-content.default\">\n<div class=\"elementor-widget-container\">\n<p>A profiss\u00e3o dos artistas e t\u00e9cnicos em espet\u00e1culos e divers\u00f5es \u00e9 regulamentada pela Lei n\u00ba 6.533\/78 e pelo Decreto n\u00ba 82.385\/78.<\/p>\n<p>De acordo com o artigo 2\u00ba, inciso I, da Lei n\u00ba 6.533\/78, artista \u00e9 todo \u201cprofissional que cria, interpreta ou executa obra de car\u00e1ter cultural de qualquer natureza, para efeito de exibi\u00e7\u00e3o ou divulga\u00e7\u00e3o p\u00fablica, atrav\u00e9s de meios de comunica\u00e7\u00e3o de massa ou em locais onde se realizem espet\u00e1culos de divers\u00e3o p\u00fablica\u201d.<\/p>\n<p>J\u00e1 o inciso II, do mesmo artigo, define que o t\u00e9cnico em espet\u00e1culos de divers\u00f5es, \u00e9 \u201co profissional que, mesmo em car\u00e1ter auxiliar, participa, individualmente ou em grupo, de atividade profissional ligada diretamente \u00e0 elabora\u00e7\u00e3o, registro, apresenta\u00e7\u00e3o ou conserva\u00e7\u00e3o de programas, espet\u00e1culos e produ\u00e7\u00f5es\u201d.<\/p>\n<p>A contrata\u00e7\u00e3o desta modalidade profissional deve ser feita por contrato de trabalho escrito, uma vez que o contrato tem que ser registrado, por requerimento do empregador, perante o antigo Minist\u00e9rio do Trabalho, conforme determina o artigo 9\u00ba, \u00a7 1\u00ba, da Lei no 6.533\/78. O artista e o t\u00e9cnico em espet\u00e1culos tamb\u00e9m devem possuir pr\u00e9vio registro na Delegacia Regional do Trabalho.<\/p>\n<p>O contrato pode ser firmado por prazo determinado ou indeterminado. O contrato por prazo determinado n\u00e3o pode ser estipulado por mais de 2 (dois) anos, nos moldes do que prev\u00ea a Consolida\u00e7\u00e3o das Leis do Trabalho.<\/p>\n<p>Outra peculiaridade desse tipo de contrato de trabalho \u00e9 que a lei autoriza o artista e o t\u00e9cnico em espet\u00e1culos a prestar servi\u00e7os a outro empregador, ainda que o contrato tenha cl\u00e1usula de exclusividade, desde que sejam observados os seguintes requisitos, de forma concomitante: (i) em atividade diversa da ajustada no contrato; (ii) a presta\u00e7\u00e3o de servi\u00e7os seja em outro meio de comunica\u00e7\u00e3o; e (iii) que n\u00e3o acarrete preju\u00edzo ao primeiro contratante, com o qual foi assinada a cl\u00e1usula de exclusividade.<\/p>\n<p><em>por Paula Blumer e Helena Waitman<\/em><\/p>\n<\/div>\n<\/div>\n<\/div>\n<\/div>\n","protected":false},"excerpt":{"rendered":"<p>A profiss\u00e3o dos artistas e t\u00e9cnicos em espet\u00e1culos e divers\u00f5es \u00e9 regulamentada pela Lei n\u00ba 6.533\/78 e pelo Decreto n\u00ba 82.385\/78.
