{"id":199,"date":"2019-06-06T16:55:05","date_gmt":"2019-06-06T19:55:05","guid":{"rendered":"https:\/\/lenglerlaw.com\/?p=199"},"modified":"2024-02-28T16:56:24","modified_gmt":"2024-02-28T19:56:24","slug":"o-impacto-da-lei-geral-de-protecao-de-dados-nos-contratos-de-trabalho","status":"publish","type":"post","link":"https:\/\/lenglerlaw.com\/en\/o-impacto-da-lei-geral-de-protecao-de-dados-nos-contratos-de-trabalho\/","title":{"rendered":"O impacto da Lei Geral de Prote\u00e7\u00e3o de Dados nos contratos de trabalho"},"content":{"rendered":"<p>A Lei Geral de Prote\u00e7\u00e3o de Dados (LGPD \u2013 Lei n\u00ba 13.709\/2018), que entrar\u00e1 em vigor em agosto de 2020, disp\u00f5e sobre a prote\u00e7\u00e3o de dados pessoais, inclusive nos meios digitais, garantindo os direitos fundamentais de liberdade, privacidade e o livre desenvolvimento da personalidade da pessoa natural.<\/p>\n<p>Sendo o direito comum fonte subsidi\u00e1ria do direito do trabalho, a LGPD ser\u00e1 aplic\u00e1vel \u00e0s rela\u00e7\u00f5es de trabalho, garantindo maior prote\u00e7\u00e3o aos dados pessoais dos empregados, visto que tal mat\u00e9ria n\u00e3o \u00e9 regulada pela Consolida\u00e7\u00e3o das Leis do Trabalho.<\/p>\n<p>Isto porque, o empregador poder\u00e1 atuar como \u201ccontrolador\u201d, \u201coperador\u201d e\/ou \u201cencarregado\u201d, conforme defini\u00e7\u00f5es da LGPD, uma vez que o empregado fornece dados pessoais que devem ser inseridos, por exemplo, em plataformas e \u00d3rg\u00e3os p\u00fablicos, tais como: INSS, eSocial, SEFIP, Receita Federal, CAGED e RAIS, dentre outros.<\/p>\n<p>A LGPD determina, dentre outros, que haja consentimento por escrito do empregado para a utiliza\u00e7\u00e3o dos seus dados pessoais, que a utiliza\u00e7\u00e3o tenha finalidade espec\u00edfica e n\u00e3o cause preju\u00edzo ao empregado.<\/p>\n<p>A t\u00edtulo de exemplo do entendimento dos Tribunais do Trabalho acerca da prote\u00e7\u00e3o dos dados pessoais do empregado, destacamos o recente julgado do Tribunal Superior do Trabalho (TST), prolatado pela Se\u00e7\u00e3o Especializada em Diss\u00eddios Coletivos, que decidiu que o empregado n\u00e3o \u00e9 obrigado a apresentar atestado m\u00e9dico ao empregador com a identifica\u00e7\u00e3o da Classifica\u00e7\u00e3o Internacional das Doen\u00e7as (CID).
